In short: pre-primary education and childcare are county functions in Kenya. The Early Childhood Education Act 2021 requires counties to register all ECDE centres through County Education Boards, and Nairobi has its own Childcare Facilities Act (2017). EduX keeps the records counties ask for and runs fees in KES, from SAR 5,000 per year.

Who registers daycares and ECDE centres in Kenya?

Under the Fourth Schedule of the Constitution, pre-primary education and childcare facilities are county functions. The Early Childhood Education Act No. 3 of 2021 (Part III, s.18) "mandates the County Government to register all ECDE centres": a centre is first registered provisionally and receives full registration from the County Education Board once it meets the criteria.

In Nairobi, the Nairobi City County Childcare Facilities Act 2017 applies; its implementing Child Care Facilities Regulations were in draft as of November 2025.

KES fees, M-Pesa and eTIMS

Kenya's VAT is 16%, and educational services are exempt. Note that eTIMS applies to "every person in business" under the Tax Procedures Act — VAT-registered or not, including schools supplying exempt services — so keep your invoicing in order. Most parents pay by M-Pesa (including Paybill) or Airtel Money; in EduX, fee and instalment plans are set in KES, parents get reminders before each due date, and every M-Pesa or bank payment is recorded against the family account with a receipt.

Children's data and the Data Protection Act

The Data Protection Act 2019 is enforced by the Office of the Data Protection Commissioner (ODPC). In EduX a teacher sees only her group, a parent only their child, and photos reach the child's family only — not a shared WhatsApp group.
